What Is Employment Retaliation?

Employment retaliation is a complicated matter, but in simple terms, it is when an employer fires you (sometimes referred to as a retaliatory discharge), denies you benefits, or denies you a promotion in retaliation for something you did. In many cases employment retaliation and retaliatory discharge are improper.

Retaliatory discharge or improper employer retaliation can include the following:

  • Getting fired for filing a workers’ compensation claim
  • Discharge for taking advantage of FMLA benefits
  • Being let go for whistle blowing under a New Jersey’s Conscientious Employee Protection Act (CEPA) or federal whistleblower statute
  • Public policy retaliation, e.g., a bartender refusing to abide by company policy not card patrons
  • Being fired for becoming pregnant

If you believe you may have been improperly fired, been improperly denied a promotion or benefits because of employment retaliation, or the victim of a wrongful termination, then contact our southern New Jersey retaliatory discharge attorneys for a confidential consultation.

What Is Employment Discrimination?

Employment discrimination can take many forms. For example, you can be denied a position, a raise, benefits, or a promotion solely based on extrinsic factors. Discrimination claims can be brought under federal statute (e.g., Title VII, Older Worker Employment Act, or Americana with Disabilities Act - ADA) or state statute (e.g., New Jersey Law Against Discrimination – LAD). Examples of impermissible employment discrimination practices, or wrongful termination, include the following:

  • Age discrimination
  • Race or racial discrimination
  • Sexual orientation discrimination
  • Sex or gender discrimination
  • Disability discrimination (ADA)
  • National origin discrimination
  • Pregnancy discrimination
  • Religious discrimination
